FILING LANDLORD/TENANT CASES
FOR ONE DEFENDANT
When filing a landlord/tenant matter with the court, you MUST provide the following:
- One (1) summons form prepared.
- One (1) complaint form prepared.
- Your copy of the demand for possession plus two additional copies.
- Three (3) copies of the lease (if this is applicable).
- One pre-stamped pre-addressed envelope addressed to each tenant (s) with the court’s return address and pre-stamped pre-addressed
- One (1) envelope addressed to the defendant (postage required)
- Envelope addressed to plaintiff/plaintiff attorney.
- One (1) copy of the landlord license.
FOR TWO OR MORE DEFENDANTS:
You must have the following documents/information to begin your suit against
two (2) defendants:
- Add an additional two copies of the summons, complaint, notice to quit, lease and one pre-addressed envelope for each defendant.
FEES:
Filing fees are $45.00 for possession. An additional filing fee will be added if
supplemental money damages are applied for. The clerk will notify you of what the
cost is for service by the court officer.
Court Officer Fee:
Must be a check or money order made payable to the proper court officer.
When using your own court officer, a Writ of Restitution can only be served
by the court officer where your judgment originated.
