HOW TO BEGIN YOUR SUIT

  • Be sure you have brought your claim against the proper party.
  • Prepare a "Summons and Complaint" form.  This must include the proper information such as the name and addresses of the parties involved in the suit.
  • Prepare a written complaint
  • Be sure you are filing in the proper venue.  The proper venue is where the incident happened or where the defendant lives.
  • The court cannot advise you as to any legal questions

CIVIL SUIT FEES

  • $35 filing fee for claims up to $600
  • $55 filing fee for claims $600-$1,750
  • $75 filing fee for claims $1,750-$10,000
  • $160 filing fee for claims $10,000-$25,000
  • $50 fee for Jury Demand
  • $15 fee for Writ
  • $15 fee for Subpoena
  • $15 fee for Garnishment
  • $25 fee for Appeal
  • $10 fee for Certified Copy
  • $20 fee for Motion
  • $75 filing fee for a judgment other than money (Claim & Delivery)
  • The process server will contact you with the service fee for personal service 

CAN I COLLECT IF I WIN?

The simple fact that the court decides in your favor does not automatically mean that the defendant will pay the judgment and costs.  You may have to take additional legal steps (i.e. garnishment of wages) to obtain your money.  Successfully collecting your money may depend on whether the other party has the proper funds to pay you.
